Although we are committed to the resolution of divorce cases in a non-adversarial manner, there are matters that require litigation, especially where one spouse may lack the information necessary to make informed decisions about the future. In that event, we are prepared to work within the court system to protect our clients' interests. At the outset of a case, it is often necessary to go to court to obtain temporary alimony and child support, or to determine the residence of a spouse and the children. At the courthouse, we often meet with Family Relations Officers to explain the client's situation in an effort to resolve the issues without a hearing or trial. If necessary, we have the experience and depth to effectively present the facts and the law to the judge and to advocate for our clients' interests.
Once temporary orders are entered, it is almost always necessary to conduct a detailed investigation of the financial situation and asset structures of the spouses. This process is usually referred to as "discovery," which can mean taking depositions and working with financial experts to evaluate the entire case. Following the discovery phase, we attempt to negotiate the best possible result for our clients, sometimes with the assistance of court-appointed Special Masters during a pretrial or by utilizing a private mediator.
If such negotiation is unsuccessful, the case proceeds to trial before a judge. Our presentation of the case is carefully prepared, including preparing the client and any experts to testify, and preparing the cross-examination of the other party and any related experts. Our presentation of the practical application of relevant laws allows us to assist the judge to evaluate the client's case. We are committed to the highest ethical and professional standards in this very difficult and stressful process.
